How The US And UK Systems Fit Together

The US taxes on citizenship, the UK on residence, and the US–UK tax treaty and foreign tax credit exist to stop that overlap becoming double taxation. In practice most of our clients pay UK tax first and then credit it against any US liability, so the extra US tax is frequently small or nil — but the return still has to be filed, correctly, every year.

The two systems do not line up neatly. The US runs on a calendar year and the UK on 6 April to 5 April, so income has to be apportioned between them. UK ISAs and many UK pensions get favourable UK treatment but are not automatically recognised by the US, which is where careful treaty and PFIC analysis earns its keep. The exclusion amounts, credit rules and reporting thresholds are set each year and can change; we confirm the current figures against IRS, HMRC and FinCEN guidance before anything is prepared, and never assume last year's number still holds.

Do I really have to file US taxes if I live in the UK?
Yes. The US taxes its citizens and green-card holders on worldwide income regardless of where they live, so the filing obligation follows you to Britain. Filing and owing are different, though — with the Foreign Earned Income Exclusion and Foreign Tax Credit, most Americans in the UK owe the US little or nothing once their UK tax is credited. The return still has to be filed each year.
Will I be taxed twice by the US and the UK?
Usually not. The US–UK tax treaty and the foreign tax credit are designed to stop the same income being taxed by both countries. In most cases you pay UK tax first and credit it against any US liability. Getting the ordering and the treaty positions right is exactly what a single cross-border adviser is for.
